Terms of service
Terms and Conditions
1. Company Information
Okaou Inc., based in Montreal, Quebec, Canada, provides products and services designed to help reunite lost children with their guardians through an online profile linked to a physical Okaou product (such as a card or keytag) containing a QR code.
2. Service Description
Okaou is an online service. Each product contains a QR code that links to a child's online profile with public and private information as described in these terms. An active subscription is required for a profile to remain active. Profiles cannot be activated without first activating an Okaou product. Even if a customer has an online subscription, it cannot be created or activated without linking it to an Okaou product.
3. Subscription Terms
Subscriptions are billed yearly. Prices may change, and any price change will be communicated to customers via email with reasonable notice, allowing time to cancel before the change takes effect.
Some Okaou products include a subscription for a set duration. These included subscriptions do not auto-renew; auto-renewal begins only after activating a subscription in the online portal. Once an included subscription Okaou product is activated, its included subscription is considered used and no longer exists as a separate entitlement.
If an included subscription Okaou product is active at the moment an online subscription is created, the online subscription will start at the expiry date of the included subscription.
If an online subscription is active and a product including a subscription is activated, the subscription period will be extended to include the new period from the product.
If a subscription is cancelled, the profile will remain active until the end date of the paid period. After that date, it will be deactivated.
4. Profile Deactivation
If a subscription expires or is cancelled, the profile is deactivated immediately after the paid period ends. The data is retained, and the profile can be reactivated later by purchasing a new subscription or activating an Okaou product that includes one. There is no grace period.
5. Payments
Payments can be made by credit card only via the online portal. Telephone payments may be added in the future.
6. Proper Use
Okaou products and services are intended for creating a profile for a specific child. Creating generic or shared profiles for multiple children is prohibited.
7. Data and Privacy
We collect and store certain personal data to operate our service.
Data is categorized as public or private:
Public information: first name, age (calculated from birth date), profile image, school (if set), “about me” description and answered questions, allergies (if set), medications (if set), and public emergency contact details.
Private information: last name, actual birth date, gender, parent account details, profile creation date, preferred language, and private emergency contact details (including full phone number, which is never displayed publicly).
Emergency contact phone numbers are never shared. When someone calls an emergency contact through Okaou, the caller is given a code, dials a fixed number, enters the code, and Twilio securely connects the call. We store the caller’s number, the call duration, the call end status, and a recording of the call.
When someone scans a profile’s QR code, they may be prompted to share their location. If they share it, we collect their location details, IP address, latitude, longitude, city, region, region code, country, country code, and postal code. If they decline, we collect their IP address and approximate location based on it. This information is not collected if the device accessing the profile is logged in by the account holder of the profile.
8. Lost or Damaged Products
We do not replace lost or damaged products, but we can deactivate them. This does not affect any active subscription. Customers can purchase additional cards, keytags, or products without a subscription at any time.
9. Liability
Okaou is a tool to help reunite lost children with their guardians but does not guarantee successful reunification. The service requires internet access and may be unavailable due to outages or maintenance. Okaou is not liable for any damages, losses, delays, or failures in communication, nor for the actions or inactions of individuals using the service. Liability is strictly limited to the cost of the purchased product or subscription.
